General travel conditions

01. Contents of the arrangement

The travel organiser guarantees that the arrangement will be carried out as described in the program. The contents of the arrangement will be delivered in full and in the manner described, except in the event of unforeseeable "force majeure" (war, terrorist acts, strikes, natural disasters, traffic and technical problems with transport, or similar).

02. Registration contract and payment

A travel registration contract can be made until all places are filled, by paying the deposit stated in each individual program. Registrations can be made at ETC Travel's offices and at all other agencies authorised to sell its programs. On registration, the buyer pays an advance of 30% of the value of the arrangement, unless otherwise stated in the program, and the remainder after the reservations department confirms the booking, no later than 15 days before the start of the arrangement or by the deadline stated in the arrangement itself. If the traveller does not pay the balance by that deadline, the organiser will consider that the traveller has withdrawn from the arrangement and will charge the cancellation costs under point 6, "Cancellation of travel by the traveller", unless otherwise stated in the program. On registration, the traveller signs a registration contract with the statement: "I declare that I am familiar with the program and the General Travel Conditions and that I accept them in full!", by which the General Travel Conditions become legally binding on both the organiser and the traveller.

03. Price of the arrangement

Prices for all trips are published in denars or euros, with payment due in the denar equivalent at the foreign-exchange market rate published by the organiser. Any request for additional services implies additional payment. The organiser reserves the right to change the price of the arrangement if the prices of hotel, transport and other services change, or if market exchange rates change. A price increase of up to 10% does not require the buyer's consent (it is calculated on the remaining balance). For an increase greater than 10%, the buyer has the right to terminate the contract without being obliged to compensate for any damage arising from the cancellation.

If, within two days of receiving the notice, the traveller does not inform the organiser in writing that they are withdrawing from the contract, they are deemed to have accepted the new price.

Any later announcement of reduced travel prices (e.g. special offers or "last minute" discounts) cannot apply to contracts already concluded and cannot be grounds for any objection or complaint by the traveller against the travel organiser.

04. Categorisation and description of services

The hotels and apartments offered are described according to the official categorisation at the time the program is published. The quality of services is standardised by the local tourism authorities. Accommodation and service standards differ between destinations and are not comparable. The organiser accepts no responsibility for any other oral or written information that does not match the description of services in the program offered.

05. Organiser's right to change the program and cancel the arrangement

The organiser has the right to change the program (its duration or contents) in the event of force majeure or extraordinary circumstances that it could not foresee, avoid or remove. The traveller is entitled to a refund of the amount for services not provided. In rare cases where accommodation in the booked property is not possible due to technical reasons or overbooking by the hotelier, the organiser will accommodate the traveller, according to the options available at the time, in a property of the same or a higher category, at no extra charge.

The organiser reserves the right to postpone or cancel the arrangement if fewer travellers register than the minimum required for that arrangement. The organiser must notify all buyers of the cancellation at least 5 days before the start of the arrangement and refund all amounts paid in full no later than 8 days from the day of cancellation.

06. Traveller's right to cancel the trip

The traveller may cancel the trip at any time, and must do so in writing. The date of the written cancellation is the basis for calculating and charging the cancellation costs (in relation to the base price of the arrangement), unless the program states otherwise. The costs are calculated according to the following scale:

  • cancellation 60 to 45 days before travel: 5% is charged
  • cancellation 44 to 30 days before travel: 10%
  • cancellation 29 to 20 days before travel: 20%
  • cancellation 19 to 15 days before travel: 40%
  • cancellation 14 to 10 days before travel: 80%
  • cancellation 09 to 06 days before travel: 90%
  • cancellation 05 to 0 days before travel, or during travel: 100%.

As an exception to the above, special cancellation-cost scales apply in the following cases:

a.) for cruises

  • cancellation 120 to 91 days before travel: 5% is charged
  • cancellation 90 to 45 days before travel: 15%
  • cancellation 44 to 29 days before travel: 30%
  • cancellation 28 to 15 days before travel: 50%
  • cancellation 14 to 07 days before travel: 80%
  • cancellation 06 to 03 days before travel: 95%
  • cancellation 03 to 0 days before travel, or during travel: 100%.

b.) for programs from the "Intercontinental travel" offer

  • cancellation 60 to 45 days before travel: 5% is charged
  • cancellation 44 to 35 days before travel: 40%
  • cancellation 34 to 30 days before travel: 60%
  • cancellation 29 to 20 days before travel: 70%
  • cancellation 19 to 15 days before travel: 90%
  • cancellation 14 to 0 days before travel, or during travel: 100%.

c.) for school excursions, outdoor school and student travel programs, where the school or faculty cancels the entire contract (for all travellers)

  • cancellation up to 120 days before travel: 5% is charged
  • cancellation 119 to 90 days before travel: 20%
  • cancellation 89 to 60 days before travel: 50%
  • cancellation 59 to 45 days before travel: 80%
  • cancellation 44 to 0 days before travel, or during travel: 100%.

If the traveller cancels the trip in good time, the organiser is entitled to a handling fee of €10 (euros) per registration contract.

If an already confirmed "on request" reservation is cancelled, the organiser will charge cancellation costs equal to the deposit paid.

If the traveller changes the departure date of the same arrangement at least 15 days before the previously confirmed departure, the organiser will change the reservation where possible and will charge only a handling fee of €10 (euros) per registration contract.

If the traveller cancels the arrangement before the start of the trip for reasons they could not foresee, avoid or remove (illness, injury or death in the immediate family, a natural disaster or similar), and on the basis of a valid certificate from the competent authorities, they do not pay the cancellation costs according to the scale above, but they do cover the actual costs arising from the cancellation that the organiser is obliged to pay to service providers without the right to a refund.

If the traveller wishes to insure themselves additionally against the unforeseeable reasons for cancelling the arrangement mentioned above, arising between signing the travel contract and the start of the trip, as well as during the trip, we recommend taking out "cancellation risk for an agreed tourist trip" insurance with an insurance company.

This insurance policy must be arranged and paid at the point of sale, at the same time as the payment for the arrangement.

If the traveller cancels the arrangement after the start of the trip (during travel or during the stay at the destination) because of events resulting from "force majeure" (war, terrorist acts, natural disasters, traffic accidents or similar) that neither the traveller nor the organiser could foresee, avoid or remove, the organiser bears no responsibility and has no obligation to refund services not provided, unless the end service provider accepts and makes a refund for them.

If the traveller cancels an arrangement that was paid at a discount or as part of the agency's special promotions (so-called first minute, early booking offers, etc.), where the discounted prices apply only if 30%, 50% or 100% of the total amount of the arrangement is paid by the discount's expiry date, the amount paid is non-refundable, meaning it is not returned to the traveller and cannot be used for another type of arrangement. When cancelling an arrangement paid at regular prices, the cancellation conditions published in the description of the arrangement and in the General Travel Conditions apply.

07. Obligations and rights of the travel organiser

The organiser is obliged to take care of the delivery of services and the choice of service providers with the care of a good organiser, and to look after travellers' interests in accordance with the professional principles of tourism. The organiser must provide the traveller with all services stated for the individual arrangement in the program.

The organiser must conclude contracts only with transport companies whose vehicles meet the conditions set by the regulations on public road transport, and whose operating approval or licence is issued, and whose operations are supervised, by the competent authority of the country in which they are registered.

The organiser must conclude contracts and carry out other business activities only with hospitality businesses that hold a licence and a category for the property, whose operating approval or licence is issued, and whose operations are supervised, by the competent authority of the country in which they are registered.

The organiser must conclude contracts only with licensed tour guides and escorts, whose operating approval or licence is issued, and whose operations are supervised, by the competent authority of the country in which they are registered.

The organiser is not liable for damage caused by errors in the operations of transport companies, hospitality businesses, tour guides and escorts that it could not foresee or avoid, and whose operating approval or licence is issued, and whose operations are supervised, by the competent authority of the country in which they are registered.

The organiser is not liable for damage caused by changes to the program or services not provided due to force majeure.

The organiser excludes all liability for changes to or non-delivery of services caused by force majeure, as well as for delays of means of transport for which the carrier is not liable under applicable regulations and international conventions.

The travel organiser accepts no responsibility if a diplomatic or consular mission refuses to issue an entry visa or is late in issuing it, or if the immigration department of a foreign country does not allow a particular traveller to enter.

The travel organiser accepts no responsibility if the traveller loses their travel document, or if the traveller's travel document is invalid, expired, or not valid for long enough to enter the country they are travelling to. In these cases the traveller pays any additional costs themselves.

In all of the above cases the organiser will provide appropriate assistance to the traveller concerned for a safe return from the trip or for pursuing any claims against the service provider, but will charge any costs arising from these additional services.

08. Obligations and rights of the traveller

The traveller is obliged to make sure that they personally, as well as their documents and belongings, meet the conditions set by the border, customs, health and other regulations of their own country and of the country they are travelling to; to observe the house rules of hospitality and hotel properties and of means of transport; and to cooperate in good faith with the organiser's representative/escort and with the service providers. If these obligations are not met, the traveller is liable to the organiser for any damage caused. Travellers who disturb order in the properties or the vehicle may be removed from the arrangement.

The traveller must hold a valid passport and must ask the competent services, or check with the organiser, whether a visa is required for the country they are travelling to (or for the countries they travel through in transit), so that they can obtain it in time. The traveller must find out about the foreign-exchange and customs regulations of their own country and of the countries they travel to. The traveller must look after, and is personally responsible for, all of their documents, money and personal luggage throughout the trip.

09. Air travel

The carriage of passengers by air is governed by the international rules of air transport and by the rules of the airline engaged by the travel organiser. All air travel on scheduled flights means passenger transport in economy class.

If the airline changes the scheduled departure time or the aircraft is delayed (on one or more scheduled or charter flights during the trip), the travel organiser is not responsible for any consequences caused by the delay; the applicable regulations and practices of air transport apply instead.

A mismatch between the personal details given to the travel organiser when booking the arrangement and the details in the traveller's passport (for example, the buyer giving shortened or incomplete names) often results in the ticket being declared irregular and new airline tickets being issued, at the traveller's expense.

These errors can cause travellers serious problems during the trip.

The traveller is responsible for their airline ticket from the moment they receive it from the agency's representative at the airport or from the travel agency clerk. It is not possible to issue a duplicate of an airline ticket or of a boarding pass for boarding the aircraft. The traveller bears all consequences of losing them before or during the trip.

09-a. Bus travel and bus transfers

Bus travel and bus transfers are carried out with standard tourist coaches in accordance with the regulations and criteria that apply in the countries where the bus company engaged by the travel organiser is registered.

As a rule, there is no predefined seating plan for travellers, nor a set way of rotating seats by day during a bus trip. Seats on the bus are allocated in order of the date the traveller registered for the arrangement. Certain bus trips may be an exception, and in such cases this is governed by a special provision in the travel program itself.

In the event of bus delays due to weather conditions, extraordinary traffic conditions, excessive waiting at borders, a technical breakdown of the vehicle or similar, the travel organiser is not responsible for any resulting delays.

Provisions regarding travel by ship or by rail are set out in the travel programs that include the use of these means of transport.

10. Luggage

The traveller is entitled to free carriage of luggage of up to 15 kg on charter flights and 20 kg on scheduled flights, plus one piece of hand luggage, unless otherwise stated in the program. On scheduled, private or charter bus transport, free luggage of one travel bag (up to 20 kg) per traveller and one piece of hand luggage is allowed, unless otherwise stated in the program. For each kilogram of luggage or travel bag above the allowance, the carrier has the right to charge additional costs per kilogram/piece or to refuse to transport it, depending on the vehicle's luggage space.

Children under 2 years of age on flights, and children who do not pay for a ticket on the bus, are entitled to free luggage in accordance with international rules. Commercial goods, food, drinks, medicines, narcotics, chemical and other flammable substances, weapons, animals, plants, packaging and similar items are not allowed as luggage. When luggage is loaded into and unloaded from the vehicle, the traveller is responsible for it and must be present. During the arrangement, the traveller looks after their own luggage. We therefore recommend taking out a travel insurance policy with luggage cover from an insurance company before the trip; it can be paid at the agency.

The organiser is not liable for damaged or lost luggage, or for items or valuables lost during the trip or the stay at the properties. We recommend renting a safe where possible.

11. Health regulations and protection

The traveller must seek information from the competent health institution and comply with the health regulations for travel to a particular country (need for a vaccine or health document). In the event of illness or an accident while using the arrangement, the costs of treatment or any medical interventions are paid by the traveller. We therefore recommend taking out a travel insurance policy with an insurance company before the trip; it can be paid at the agency.

12. Accommodation in rooms and apartments

If the traveller has not booked a room/apartment with specific features, they will accept any officially registered room/apartment in the booked property as described in the catalogue and price list. Where possible, the organiser will try to meet the traveller's additional requests (comfort, room orientation, floor and similar), but cannot guarantee that such a request will be fulfilled. Check-in to rooms is usually from 14:00 and check-out is by 10:00 (unless the house rules state otherwise).
